IMPORTANT NOTICE (PLEASE READ):

BY SIGNING OR RECEIVING THE INVOICE RECEIPT BY EMAIL, SCHEDULING DELIVERY, OR ACCEPTING DELIVERY/PICKUP, YOU AGREE TO THESE TERMS, WHICH ARE INCORPORATED BY REFERENCE INTO YOUR SALES AGREEMENT. CERTAIN PROVISIONS ARE IN ALL CAPS FOR EMPHASIS/CONSPICUITY. THESE TERMS DO NOT LIMIT ANY NON-WAIVABLE CONSUMER RIGHTS UNDER APPLICABLE LAW.

1)  DEFINITIONS & SCOPE

"Seller," "we," "us," "our" means Northeast Hot Tub Service & Movers. "Buyer," "you," "your" means the customer named on the invoice. "Products" include spas, swim spas, mattresses, adjustable bases, massage chairs, furniture, chemicals, accessories, and related services. These Terms apply to all purchases, deliveries, pickups, and services unless a signed written agreement states otherwise.

2)  ACCEPTANCE OF TERMS

By signing or receiving the invoice receipt by email, paying any amount toward the order, scheduling delivery, or accepting delivery/pickup, you acknowledge and agree to these Terms (as posted online). For clarity, the Buyer's invoice states that the customer has reviewed our Terms & Policies available below and agrees to abide by them.

3)  DELIVERY DATE & TIME (GENERAL)

Delivery windows are estimates and may vary due to weather, traffic, safety, and unforeseen conditions. You (or an adult designee) must be present to sign the delivery manifest, inspect the Products, and complete any pending payments, except as provided in Section 10.4 (Delivery Contact Policy; Authority to Leave Product). If you are not present within the scheduled window, a redelivery fee may apply.

4)  STANDARD SPA / SWIM SPA DELIVERY

Eligibility: Addresses within 50 miles of a seller service center (additional mileage fees may apply beyond 50 miles). Buyer must provide a clear, level path with 40" minimum width and 9'0" minimum vertical clearance to the set location. Delivery includes placement of the spa, basic component installation (cover, cover locks, cover lifter, steps, SwimDek where applicable), and basic operating/chemical orientation. Electrical hookup is not included and must be performed by a licensed electricianBuyer represents that the set pad/foundation meets manufacturer specifications (level, load-bearing, clearance). Seller is not responsible for settling, cracking, or mis-level resulting from an inadequate pad/foundation.

Condition at Arrival: Buyer must note any damage on the delivery manifest before the delivery team departs and report to Seller within 24 hours with photos. If minor cosmetic or functional defects are discovered at delivery, Buyer agrees to allow a reasonable on-site repair or prompt parts replacement. If the unit cannot be made fully functional within a reasonable time, Seller will replace the unit at no charge.

Post-Delivery Warranty Service: After delivery and installation are complete, defects are serviced under the manufacturer's warranty. Seller will help coordinate warranty service consistent with manufacturer procedures and timelines.

Delivery Liability (Route Waiver): Seller is not responsible for damage to lawns, landscaping, irrigation, floors, walls, doorways, trim, surfaces, or fixtures when Buyer directs a route without adequate clearance or requests movement over non-standard obstacles (e.g., stairs, fences, steep slopes). EXCEPT FOR OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, SELLER'S LIABILITY FOR DELIVERY-RELATED DAMAGE IS LIMITED TO REPAIR OR REASONABLE COST TO REPAIR THE AFFECTED AREA, CAPPED AT THE DELIVERY FEE PAID. 5)  NON-STANDARD SPA / SWIM SPA DELIVERY SERVICES

Additional charges apply for services not included in Section 4, including: additional mileage beyond 50 miles; crane/specialty equipment; extra personnel; ramps; movement over obstacles/tight clearances; installation of accessories not sold with the spa; difficult terrain; or unusual access constraints. A $500 additional fee applies for swim spa placement. Pricing may vary based on site conditions and will be quoted in advance when reasonably knowable. Seller may stop or cancel delivery if site conditions pose unreasonable risk of injury or loss.

6)  SPA DELIVERY NOTES & BUYER RESPONSIBILITIES

If delivery crosses a lawn, do not water within 48 hours prior to delivery. Buyer confirms adequate access and set location before scheduling. Any damage noted after the delivery team departs may not be honored by the delivery provider. Electrical hookup and required disconnects/breakers are the Buyer's responsibility; improper electrical work may void service for power-related issues. If Buyer is not ready to accept delivery by the scheduled date, storage fees may apply.

7)  STANDARD MASSAGE CHAIR DELIVERY

If a new massage chair is delivered with flaws or damages noted at delivery, Seller will repair or replace at no charge to Buyer consistent with Section 4. If a defect is discovered after delivery is completed, Buyer must contact the manufacturer to have the massage chair serviced under manufacturer guidelines. Floor model/outlet massage chairs may have cosmetic blemishes, are sold as-is/final sale, and may be repaired or credited at Seller's discretion for cosmetic issues (no returns). When in-home delivery cannot be completed, we will protect the product from the elements within reason and coordinate a new appointment (redelivery fees may apply).

7.1) SAUNA DELIVERY (CURBSIDE/DRIVEWAY)

We will deliver the sauna to your driveway/curbside, securely packaged by the manufacturer. In-home placement, assembly, or electrical work are not included unless expressly quoted in writing.

Inspection & Damage Notation: Buyer must inspect packaging at delivery. Any visible damage must be noted on the delivery manifest before the drivers depart and reported to Seller within 24 hours with photos.

For concealed damage discovered after delivery, notify Seller promptly with photos so we can initiate a manufacturer claim.

Repair/Parts Remedy: Buyer agrees to provide Seller a reasonable opportunity to order replacement parts from the manufacturer and perform repairs as needed. Refusal of delivery or cancellation due to damage that is reasonably correctable by replacement parts is not permitted under these Terms.

Refusal/Cancellation: If Buyer refuses delivery or cancels the sauna order outside the permitted cancellation window (see Section 10), a 35% restocking fee plus applicable freight/handling and pick-up charges will apply.

Electrical Hookup & Packaging: Any required electrical hookup must be performed by a licensed electrician; improper electrical work may void service for power-related issues. Disposal of manufacturer packaging/crate is the Buyer's responsibility unless Seller's in-home service is separately purchased.

8)  STANDARD DELIVERY

Delivery crews are insured to set up newly purchased merchandise only. Inspect items before drivers depart; note any product/property damage on the manifest before the team leaves and report to the store of your original purchase within 24 hours with photos.

9)  MERCHANDISE PICKUP (TITLE & RISK OF LOSS)

When Buyer elects pickup instead of delivery, title and risk of loss transfer to Buyer when the merchandise exits our store/warehouse. Use a covered vehicle and secure items properly. At Buyer's request and sole risk, our staff may assist with loading/strapping; Seller is not responsible for damage attributable to transport.

10)  REFUNDS & CANCELLATIONS

THREE (3)-DAY RIGHT TO CANCEL: Orders may be canceled within three (3) calendar days of the purchase date for a refund to the original payment method (less delivered services and special-order costs already incurred).

AFTER THREE (3) DAYS, ALL SALES ARE FINAL for spas, swim spas, massage chairs, adjustable bases, chemicals, and accessories. Mattresses follow the Sleep Well Guarantee (Section 11). Clearance, floor models, discontinued, "as-is," and outlet items are FINAL SALE.

Special/Custom Orders: Custom configurations or non-stock items are noncancelable after submission to the manufacturer. If Seller approves a post-deadline cancellation or return, a restocking fee up to 35% plus freight/handling may apply.

Discretionary Spa Returns: Spa/swim spa sales are final. If Seller approves a return in its sole discretion, a 35% restocking fee plus pick-up, cleaning, and freight costs will be deducted from any refund. Operational or cosmetic defects are addressed under manufacturer warranty (repair/parts replacement or replacement unit per Section 4).

10.3 Show & Event Sales - Three-Day Right to Cancel

For any Product sold at an off-site show, expo, fair, or event (an "Event Sale"), Buyer has a three (3) calendar-day right to cancel from the purchase date. To exercise this right, Buyer must email the Owner at This email address is being protected from spambots. You need JavaScript enabled to view it. within the three-day period with the order/invoice number and a clear request to cancel. After the three-day period, all Event Sales are final and noncancelable.

10.4 Delivery Contact Policy - Authority to Leave Product; Delivery-Fee Refund

If, during the scheduled delivery window, Seller's delivery team is unable to reach Buyer by phone, text, or email or at the door, Buyer authorizes Seller, at its discretion, to leave the Product at the delivery address (e.g., driveway, garage exterior, covered porch, or other reasonably protected area) and to photograph the placement for records. In such case: (i) Seller's obligation to deliver is satisfied; (ii) the sale is final; and (iii) the delivery fee (if any) will be refunded to the original payment method, so Buyer may make separate arrangements to bring the Product inside. Risk of loss transfers upon placement at the delivery address. Seller is not responsible for theft, weather exposure, or damage occurring after placement, except for gross negligence or willful misconduct.

Exclusions: online-only sellers, membership clubs, doorbusters, clearance/floor models/open-box, vendor rollbacks/rebates, special-purchase/promotional bundles, discontinued items, offers with different terms (delivery/setup/taxes/financing), price errors/misprints, and written quotes or negotiated prices. The advertisement must be current, verifiable, and for the same brand/model/SKU and delivery terms. See Appendix A (Price-Match Claim Form).

11)  WARRANTIES (MANUFACTURER) & SELLER DISCLAIMERS

New Products may include manufacturer warranties - please review the manufacturer's warranty booklet/website for terms, coverage, and service procedures. Seller will assist in initiating service where appropriate.

SELLER DOES NOT PROVIDE A SEPARATE WRITTEN WARRANTY ON NEW PRODUCTS AND, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL IMPLIED WARRANTIES (INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) BEYOND THE DURATION AND SCOPE OF ANY APPLICABLE MANUFACTURER WARRANTY. Some jurisdictions do not allow limitations on the duration of implied warranties; where prohibited, this disclaimer does not apply and your rights may vary.

AS-IS / FINAL-SALE ITEMS (INCLUDING CLEARANCE, FLOOR MODELS, DISCONTINUED, OUTLET): SOLD AS IS, WITH ALL FAULTS; NO WARRANTIES BY SELLER.

12)  LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, SELLER'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE PRODUCTS OR SERVICES SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. IN NO EVENT SHALL SELLER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOSS OF USE, EVEN IF ADVISED OF THE POSSIBILITY.

13)  FORCE MAJEURE

Seller is not liable for delays or failures caused by events beyond its reasonable control, including weather, accidents, strikes, supply-chain disruptions, acts of God, utility outages, or government actions. Affected timelines will be extended for the period of delay.

14)  DISPUTE RESOLUTION; CHARGEBACKS; GOVERNING LAW

Good-Faith Cure: Before initiating any bank dispute/chargeback or legal action, Buyer agrees to provide written notice to Seller and a reasonable opportunity to have a plan (up to 10 business days) to cure consistent with these Terms.

  • Arbitration (Optional if permitted by law): Except for claims that may be brought in small-claims court, any dispute shall be resolved by binding arbitration on an individual basis under the rules of the American Arbitration Association. NO CLASS ACTIONS OR CONSOLIDATED ARBITRATIONS. The seat of arbitration is Albany County, New York. Each party bears its own fees unless the arbitrator awards otherwise as permitted by law.
  • Governing Law & Venue: These Terms are governed by New York law without regard to conflicts principles. Subject to the arbitration clause, exclusive venue is in the state or federal courts of Albany County, New York. Severability: If any provision is found unenforceable, it will be modified to the minimum extent necessary to be enforceable, and the remainder will remain in effect.

15)  PHOTOGRAPHY / SITE DOCUMENTATION CONSENT

Buyer permits Seller's delivery/service personnel to photograph or video the delivery path, installation area, and the Product for the limited purposes of documenting condition, fit/access, and warranty/service records.

16)  NOTICES & CONTACT

Provide notices to the store of purchase (as listed on your invoice) or via the contact methods posted on our website. Keep your contact information current to receive service updates.

17)  ENTIRE AGREEMENT; NO ORAL MODIFICATIONS

These Terms, together with your invoice/order and any written, signed addenda, constitute the entire agreement and supersede prior oral statements. No employee has authority to modify these Terms except in a signed writing by an authorized manager.

18)  CARD PAYMENTS; AMERICAN EXPRESS (EXCEPTION POLICY)

We do not accept American Express as a standard payment method. If Seller, in its sole discretion, makes a written exception to accept an American Express card for a specific transaction:

  • Good-Faith Cure First. Buyer agrees to follow the dispute process in Section 17 (Good-Faith Cure) and allow Seller a reasonable opportunity to resolve any issue before contacting the card issuer or initiating a dispute.
    • Chargebacks. Buyer acknowledges that these Terms & Conditions and applicable manufacturer warranties govern the transaction and agrees not to initiate a card-issuer chargeback, to the fullest extent permitted by applicable law and card-network rules.
    • No Waiver of Non-Waivable Rights. Nothing in this Section limits any non-waivable consumer protections under applicable law or card-network rules.

19)  CHANGES TO TERMS

Seller may update these Terms from time to time at its sole discretion.
